Dominican man's detention case reaches Supreme Court over bond hearings
D.C., a 62-year-old Dominican citizen who entered the U.S. without authorization, has been held by ICE since September 2025 after completing a state prison sentence tied to a 1998 drug conviction, along with earlier convictions for possessing a forged instrument, a domestic assault, and criminal contempt. A district court ordered that he receive a bond hearing under Second Circuit precedent requiring hearings when mandatory detention becomes 'unreasonably prolonged,' but denied his request for immediate release. The Supreme Court has now agreed to hear the Trump administration's appeal in the case, Genalo v. D.C., to decide whether the government must prove by clear and convincing evidence that he poses a flight risk or danger to remain in custody; the case is part of a broader dispute over a July 2025 policy mandating detention for immigrants in deportation proceedings.
