Deaf Mongolian asylum seeker held 4 months without interpreter, judge orders fix

Jul 9, 2025San Diego, CAMongolia

A deaf Mongolian man, identified by the pseudonym Avirmed to protect his family from retaliation, has spent more than four months at the Otay Mesa Detention Center in San Diego without access to anyone who understands Mongolian Sign Language, according to his attorney Alegría De La Cruz of the Disability Rights Legal Center. Avirmed entered the U.S. in February 2025 seeking asylum after a 2020 assault in Mongolia left him deaf with a traumatic brain injury causing seizures and memory loss; his attorneys say he gave border officials a letter explaining his disability and asylum request, which Customs and Border Protection agents refused to accept. U.S. District Judge Dana Sabraw ordered officials to provide him a Mongolian Sign Language interpreter and to redo his mental health and credible-fear assessments. His attorney said he has effectively been isolated because no one has been able to communicate with him in his sign language throughout his detention and legal proceedings.

In the following days, Southeast Side residents organized community defense efforts, including filming and reporting immigration activity, with local groups such as the Illinois Coalition for Immigrant and Refugee Rights and Centro de Trabajadores Unidos holding a press conference to rally support for rapid-response and deportation-defense work. Video reviewed by NBC 5 Investigates shows a protester struck in the back of the head and face by a pepper ball during a September 26 demonstration, and another protester's back was covered in bruises from apparent pepper ball strikes. The incidents have raised questions about whether agents violated Border Patrol's own use-of-force policy, which restricts targeting the head, neck, spine or groin with compressed air launchers, as well as a judge's standing order limiting use of chemical agents.
