Asylum seeker ordered released after habeas corpus petition granted
ICE agents detained a Bronx asylum seeker at an immigration court in Manhattan while he attended a mandatory asylum hearing, despite a May 2026 federal court order prohibiting such arrests, and transferred him to Delaney Hall detention facility in New Jersey. The man, who had no criminal convictions and had complied with all immigration directives, filed a habeas corpus petition challenging his detention. On August 22, 2026, the government filed a notice of non-opposition to his release, and U.S. District Judge Gregory H. Woods granted the petition, ordering his immediate release.
