Dominican man's ICE detention fuels Supreme Court fight over bond hearings

Sep 27, 2026Dominican Republic

D.C., a 62-year-old Dominican citizen who entered the U.S. without authorization, has been held by ICE since September 2025 after completing a state prison sentence tied to a 1998 drug conviction, along with earlier convictions for possessing a forged instrument, a domestic assault, and criminal contempt. A district court ordered that he receive a bond hearing under Second Circuit precedent requiring hearings when mandatory detention becomes 'unreasonably prolonged,' but denied his request for immediate release. The Trump administration is now asking the Supreme Court to review the case, known as Genalo v. D.C., to decide whether the government must prove by clear and convincing evidence that he poses a flight risk or danger to remain in custody.
