U.S. citizen pinned against fence by Border Patrol agents over his birthplace, joins ACLU suit
Brian Gavidia, a 29-year-old U.S. citizen born and raised in East Los Angeles, was confronted by armed Border Patrol agents on June 12, 2025, at his car lot workplace on West Olympic Boulevard in Montebello during an immigration sweep in the San Gabriel Valley. Despite repeatedly stating he was American and offering his Real ID, agents pushed him against a metal gate, twisted his arm, and demanded to know where he was born, while a friend filming the encounter was injured after being pushed by another agent. Video captured Gavidia saying 'I'm American, bro!' as agents confiscated his ID and phone; he said he feared for his life when an agent racked a chamber in an AR-15. He was briefly held on suspicion of interfering with the operation before being released once his citizenship was confirmed. Gavidia, whose mother is Colombian and father is Salvadoran, was forced to close his used-car business as agents kept returning to the neighborhood, and had to tell his nine-year-old daughter she could not visit from Portland because it was not safe. He has since joined an ACLU class-action lawsuit challenging the enforcement tactics, renounced his prior support for President Trump, and now helps lead know-your-rights workshops.
