Dominican immigrant's Supreme Court detention case dropped after governor's pardon

Sep 11, 2026New York, NYDominican Republic

G.M., a lawful permanent resident from the Dominican Republic, was arrested by ICE at his home on Oct. 5, 2020, and held for 21 months without a bond hearing during removal proceedings tied to a 2015 second-degree assault conviction. He was released in 2022 after a nationwide injunction required ICE to review the custody status of detainees with certain medical conditions, though the legal questions in his case remained unresolved. His case had been scheduled for Supreme Court arguments in October, but it was dismissed as moot on Sept. 11, 2026, after New York Gov. Kathy Hochul granted him a full pardon for the assault conviction in late August, eliminating the legal basis for his detention and deportation.

Herzberg sustained injuries including a concussion, abrasions, bruising, chest contusions, and breathing issues. On August 27, Herzberg filed a federal lawsuit against DHS alleging battery and unconstitutional use of force. Federal authorities also charged Herzberg with obstructing the facility and throwing objects; his attorney characterizes these charges as bogus and retaliatory.

Salvadoran man freed after judge rules months-long ICE detention violated due process

Aug 27, 2025San Diego, CAEl Salvador

David Antonio Aviles Perez, a 35-year-old Salvadoran national known as 'La Bruja,' was arrested by ICE in San Diego on March 26, 2025, and held at Otay Mesa Detention Center for nearly five months without a bond hearing. U.S. District Judge Jinsook Ohta ruled on August 26, 2025 that immigration officials violated his Fifth Amendment rights by failing to make an individualized assessment of danger or flight risk, ordering his release and barring re-detention unless an immigration judge independently finds it warranted. In December 2025, a court in El Salvador convicted him in absentia of aggravated murder for a July 2014 killing in La Union and sentenced him to 20 years. Homeland Security Secretary Markwayne Mullin publicly criticized Ohta as an 'activist judge,' saying her ruling released a 'wanted murderer.'

Deaf disabled teen handcuffed at gunpoint outside LA school in mistaken ID case

Aug 26, 2025Los Angeles, CA

Baldemar Gutierrez, a 15-year-old U.S. citizen with significant hearing loss and speech delays, was pulled from a car and handcuffed at gunpoint by masked federal agents outside Arleta High School in Los Angeles while his mother, Andreina Mejia, was nearby enrolling his sister. Agents showed a photo of a Salvadoran national suspected of gang ties and mistook Baldemar for him, releasing him only after he repeatedly stated his name and citizenship; the encounter lasted about seven minutes before agents realized their error. His mother said an agent told him the mistake would make an 'exciting story to tell' his friends, and she said her son has since felt harassed and unsafe. School officials said agents wearing 'police' and 'Border Patrol' insignia left bullets at the scene, prompting increased school police patrols. The family's attorneys later filed a $1 million claim against DHS, CBP, Border Patrol and ICE alleging racial profiling, false arrest, false imprisonment, and assault and battery; DHS denied racial profiling, calling it a case of mistaken identity.

Ecuadorian father arrested by masked ICE agents at Federal Plaza as children clung to him

August 26, 2025New York, NYEcuador

Luis, an Ecuadorian mechanic and father of three, was arrested by masked ICE agents on August 26 after leaving a courtroom on the 12th floor of 26 Federal Plaza in Lower Manhattan with his wife Cocha and their children, ages 7, 13, and 15. The family had attended a routine immigration hearing and believed his case had been extended for another year when agents grabbed Luis without explanation. His children leapt onto him, clutching his shirt to stay together, but an ICE agent violently yanked one of his daughters backward to pry them apart. His 7-year-old son was left weeping as a masked agent blocked the family with his arm. The family came to the U.S. from Ecuador 2.5 years ago, making the journey on foot and by car, fleeing local corruption and fearing for their children's futures. Luis works as a mechanic and is the family's sole financial support. Cocha, who stayed home to care for the children, does not know where her husband was taken or what to do without him.

Guatemalan father detained 9 months wins release after immigration judge failed to justify continued detention

Aug 26, 2025Los Angeles, CAGuatemala

A Guatemalan father of three, a native and citizen of Guatemala, has resided in Los Angeles with his family for many years and has three biological children who are United States citizens. He was arrested by immigration authorities on August 26, 2025, and has been detained at the Adelanto ICE Processing Center since that time. He is pending removal proceedings and is seeking Cancellation of Removal relief. An immigration judge denied bond at two hearings—one on January 12, 2026 (where he bore the burden of proof) and another on March 2, 2026 (where the government bore the burden)—based solely on his prior DUI conviction and immigration history, without adequately considering his family ties, stable residence, or lack of criminal history involving moral turpitude. The federal magistrate judge found the March 2, 2026 bond denial was an abuse of discretion because the immigration judge failed to conduct an individualized assessment, consider mitigating factors, or address alternatives to detention as required by the Rodriguez class action injunction. The court ordered his immediate release on his prior conditions of supervision and enjoined further detention without a compliant bond hearing.

Grandmother's ICE injuries reach Congress as lawmaker demands agent accountability

Aug 25, 2025Oregon

U.S. Immigration and Customs Enforcement agents stopped a U.S. citizen of seven years on Jan. 29 while she was driving to pick up a cake for her grandson's birthday, shattering her car window, dragging her from her vehicle and throwing her to the ground before leaving without calling for medical help. She sustained a torn rotator cuff, a concussion and bruised ribs. On July 28, U.S. Rep. Andrea Salinas raised her case at a congressional hearing on ICE accountability, calling for body cameras on immigration agents and independent investigations when agents injure people. Salem Police told her daughter they could not investigate federal officer misconduct and referred her to the FBI and the Department of Homeland Security, which has not responded to questions about the stop.

Woman arrested after livestreaming ICE detention in Fort Myers

Aug 25, 2025Fort Myers, FL

She told N+ Univision she began filming on her way to work to alert her community, but agents surrounded her truck and a Florida Highway Patrol vehicle blocked her path. She livestreamed a 28-second video on Facebook showing agents breaking her vehicle's window before pulling her out by the hair, throwing her to the ground, and pressing their knees against her neck. She was booked into the Lee County jail on a charge of resisting an officer, not an immigration charge, and was held for nine days until September 3, during which she says she lost about 16 pounds. "I feel like I can't trust anyone, I feel abandoned, I feel like I can't call 911. I have anxiety, I don't want to go out; I'm terrified to go outside," she said.

Aug 24, 2025Bloomington, MN

Adrian Sotelo Guzman, a 27-year-old who came to the U.S. as a child and previously held DACA status, was removed by ICE from M Health Fairview Southdale Hospital in Edina while under a court-ordered hold for psychosis related to bipolar disorder, then transferred to a behavioral health facility in El Paso, Texas. A federal judge had approved the Department of Homeland Security's request for his removal despite hospital staff determining he was not stable for discharge, and his family says he was denied contact during the transfer. A newly filed federal petition in the Western District of Texas alleges his mental state has not improved since the transfer and that his family and attorneys have been unable to visit him or hold meaningful phone conversations with him. The petition asks the court to order his release from custody or require the government to justify his detention and ensure proper treatment; his arrest in St. Paul in February occurred during a large-scale immigration enforcement operation.

Video of the arrest showed multiple men unbuckling and forcibly removing her from the vehicle while misgendering her. DHS said Barbosa overstayed her B-2 tourist visa by nearly six years and cited prior arrests for drug possession as reasons for the detainment; a senior DHS official also referred to her by her birth name and male pronouns when asked for comment. She has since been held at the Caroline Detention Center in Virginia, and ICE has announced plans to deport her. Brazilian Congresswoman Erika Hilton called the arrest unconstitutional and asked Brazil's Foreign Ministry to intervene, and the Brazilian Consulate General in Washington said it is monitoring the case and providing consular assistance. A friend, describing her as a vibrant volleyball player and beloved daughter, started a GoFundMe to help fund her legal defense.
