Colombian asylum seeker detained at routine ICE check-in after DUI arrest, court orders release

Sep 23, 2026Fremont, CAColombia

A Colombian asylum seeker who fled to the United States in 2022 was detained without warning while attending a routine ICE check-in in San Francisco. He had previously been released from custody after DHS determined he posed no danger or flight risk, and he attended every scheduled check-in since then. He held employment authorization and a Social Security number, worked assembling ventilation and refrigeration equipment, filed federal tax returns for two years, resided in Fremont, California, had a partner of one year, and regularly attended a Mormon temple. In June 2026, he was arrested for an alleged DUI after being found sleeping in his parked car outside his home. He was not shown a warrant at his re-arrest and was subsequently transferred to the Central Valley Annex detention facility in McFarland, California. He filed a habeas petition and motion for a temporary restraining order, arguing his detention violated due process because he was not given a pre-detention bond hearing. The court granted the TRO, ordering his immediate release and barring re-detention pending further briefing and a hearing scheduled for October 8, 2026.

Eliaser legally entered the U.S. on a tourist visa in June 2019 but overstayed it; she had previously applied for asylum and later sought a green card through marriage. Jaramillo, 43, who has served in the Army for 11 years as an aviation operations specialist at Fort Polk, Louisiana, was forced to take administrative leave to care for their 5-year-old stepson, Noah. Jaramillo told reporters the experience was "really overwhelming" and that he feels "betrayed" by the detention, saying "I need to take care of my kid by myself. No one is here to help me out." Court records indicate ICE officer Waite has a documented history of collaboration with Washington law enforcement and anti-immigrant social media posts.

He was ordered removed on July 18, 2007, with his removal order becoming final on December 12, 2007 when the Board of Immigration Appeals denied his appeal. He was designated for removal to Kuwait with Egypt as an alternative destination. After being released from ICE detention on July 3, 2008, he was re-detained on July 7, 2025 at a routine ICE check-in without notice or opportunity to contest the revocation of his release. Over nine months of continued detention, ICE made only one documented effort to secure travel documents—a letter sent to Egypt in January 2026, six months after his re-detention, with no response received. The court found no significant likelihood of removal in the reasonably foreseeable future and granted his habeas corpus petition, ordering his immediate release on the same conditions as before his re-detention, with protections against re-detention without a pre-detention hearing and restrictions on removal to a third country without due process.

LAPD said it has fielded at least seven 911 calls reporting kidnappings that turned out to be ICE operations, and McDonnell emphasized that LAPD does not participate in immigration enforcement under state law. State Sen. Sasha Renée Pérez has separately introduced the “No Vigilantes Act” to bar bounty hunters from immigration enforcement and require visible identification by agents.
