Brazilian father detained without bond hearing after traffic stop, case goes to Supreme Court

Oct 1, 2026Buffalo, NYBrazil

Ricardo Aparecido Barbosa da Cunha, a Brazilian immigrant who has lived in the U.S. for over 20 years and owns a home and business in Massachusetts with his wife and two U.S.-born children, was detained by ICE in September 2025 after a traffic stop in Norwood, Massachusetts while driving to work. He had an asylum application and work permit after entering the country around 2005. Under a Trump administration policy issued in July 2025, DHS classified him as an 'applicant for admission' subject to mandatory detention and held him without a bond hearing in Buffalo, New York. He challenged the detention in federal court; a district judge ordered his release, and he was later released on bond. The Second Circuit Court of Appeals unanimously rejected the government's interpretation, joining judges in nine of eleven federal appeals courts who have ruled against it. On October 1, 2026, the Supreme Court granted certiorari to review the administration's appeal, with the ACLU warning the case could affect thousands to millions of noncitizens detained under the same policy.

Agents had entered his backyard and porch searching for his eldest son, who shares his name, and after forcing open his car and handcuffing him, realized roughly 45 minutes to an hour later they had the wrong person—but detained him anyway. Orozco has no criminal record, arrived in the U.S. in the late 1990s under a legal work petition, and was issued a removal order in 2004 after visiting his father in Mexico. He has remained in ICE custody in Kentucky for nearly six months, during which his family has missed mortgage payments, his younger son has struggled to keep the family business running, and his wife Yolanda, who has spoken publicly about the case, has been fighting breast cancer. His attorneys at the National Immigrant Justice Center, representing Orozco as one of 22 detainees, have filed a motion challenging the legality of warrantless ICE arrests and are seeking his release.

Mar 14, 2025Liberty, MO

The judge found 11 of the 12 arrests lacked probable cause, ruling only one lawful due to prior removal history, and found agents had prepared forms justifying the arrests that did not include facts supporting probable cause.
