Guatemalan father detained by ICE after 22 years in US wins court order for release

He is engaged to a U.S. citizen and is the father of three U.S. citizens. Following his detention, he was transferred to the San Bernardino Sub Office and held at Adelanto Detention Facility. On March 31, 2026, he filed a Petition for Writ of Habeas Corpus seeking immediate release or a bond hearing within seven days, raising claims of unlawful denial of a bond hearing under 8 U.S.C. § 1226(a), violation of Fifth Amendment due process rights, and violation of the Administrative Procedure Act. On April 13, 2026, the U.S. District Court for the Central District of California granted his Petition for Temporary Restraining Order, finding that he is entitled to an individualized bond hearing as a member of the Bond Eligible Class established in Bautista v. Santacruz. The court ordered respondents to either provide evidence that he received a bond hearing or release him from custody within 48 hours, with no release restrictions such as electronic monitoring unless deemed necessary at a future bond hearing.

U.S. Citizen rammed by ICE in Simi Valley, hospitalized while handcuffed

Video footage shows agents in four vehicles blocking and ramming Martinez's minivan as he tried to reverse away, with one agent emerging with an assault rifle raised; a photographer identified an emblem on an agent's hat matching one worn by an agent at a prior protest at the Metropolitan Detention Center. Simi Valley police also arrived and sought to question Martinez about the collision, but he requested legal counsel before speaking; agents then broke his window and dragged him out as he held his arms out to be handcuffed, injuring his knees, shoulders, and wrists. He was treated and later discharged from Los Robles Regional Medical Center around noon, and his minivan was impounded. This marks the third time ICE agents have rammed Martinez's vehicle; a previous incident on October 16, 2025, in Oxnard also led to his detention and transfer to the Metropolitan Detention Center in Los Angeles.

Guatemalan man detained without hearing while en route to work, granted habeas petition

Deaf child deported without hearing aids after mother detained at ICE check-in

The deaf child was separated from his hearing aids and assistive equipment during detention, despite a family member being present outside willing to provide them. Her attorney stated ICE misled his team about the family's whereabouts throughout the week and obstructed access to counsel, preventing the family from invoking humanitarian protections. California officials and immigration attorneys subsequently called for the family's return.

Ruben deported after arrest at asylum appointment in San Francisco immigration court

Ruben, 28, a Nicaraguan immigrant who had been living in San Francisco's Mission District with his brother Francisco since October 2022, was arrested on February 17 while arriving for his asylum appointment at the Sansome Street immigration court. Francisco and Ruben had worked together and lived as a unit for three years in the Mission, sharing meals and supporting each other as they built their lives in the United States. Ruben's prior immigration appointment had been changed without his notification, and he failed to file the necessary motion to explain his missed hearing, which proved fatal to his case. He was detained and transferred through multiple detention facilities—Mesa Verde in Bakersfield, a facility in Arizona, and Puerto Isabel in Texas—before being deported to Nicaragua on March 8.

Fresno restaurant manager released after nine months in ICE detention over 2002 burglary

Psalm "Sam" Behpoor, 42, manager of Pismo's Coastal Grill in Fresno, was detained by ICE on June 23, 2025, after reporting for a routine check-in, where he was separated from his attorney. He came to the U.S. from Iran as a toddler after his family fled the Iranian Revolution, and says he has had no trouble with the law since a non-aggravated burglary conviction at age 18, nearly 25 years earlier. He had filed paperwork to reinstate his green card and was held at the Mesa Verde ICE Processing Center in Bakersfield without a scheduled hearing. His wife, Lera Mirakyan, said their 3-year-old son repeatedly asked for his father, and employer Dave Fansler called him "the best of the best." Community members raised more than $30,000 for his family, and Fresno councilmembers sent ICE a letter of support. Gov. Gavin Newsom pardoned Behpoor for the old offense in November 2025, and after new legal filings corrected errors in his case, he was released on bond after nine months in detention. "Seeing my wife and my child again was everything," Behpoor said, though further immigration hearings remain pending and he says he cannot legally be deported to Iran.

Vietnamese Immigrant Detained After 20 Years on Supervised Release

Iranian man detained at airport after 14 years on supervised release wins habeas challenge

An Iranian citizen born in Germany in 1990 who has lived in the United States for over 20 years since entering at age 15. He is employed full-time as a Project Manager for J.T. Construction Group and works as an In-Home Supportive Service provider caring for his parents, who are now U.S. citizens. In 2012, he was ordered removed to Iran but granted withholding of removal, and was placed on an order of supervision (OSUP). On March 5, 2026, ICE officers arrested him at Burbank Airport without providing meaningful notice or opportunity to be heard, claiming his case was under review for removal to an unnamed third country. ICE detained him at the Adelanto ICE Processing Center. A federal magistrate judge granted his habeas petition, finding no showing of changed circumstances for revocation, violation of due process procedures, and inadequate third-country removal safeguards. The court ordered his immediate release subject to his prior OSUP conditions and prohibited removal to a third country without written notice and a minimum 10-day opportunity to raise fear-based claims.

Former LA County foster youth advocate self-deports to Mexico after detention

Axel Pecero, 25, a former Los Angeles County foster youth and advocate for youth in child welfare and juvenile justice systems, was detained by ICE in August 2025 after being stopped by Burbank police. El Salvadoran man detained for five months without bond hearing ordered released

A citizen of El Salvador who has lived in the United States for approximately 20 years, having entered on November 26, 2005, has a United States citizen child and has worked in the country with no prior removal order. On March 4, 2026, ICE officers apprehended him in Simi Valley, California during a field operation as he exited his vehicle. Officers did not provide him a warrant until after arrest and did not provide a pre-deprivation opportunity to contest his detention. He has been held at Desert View Annex in Adelanto, California since his detention and has never received a bond hearing before an immigration judge, with no neutral decisionmaker reviewing whether his continued detention was warranted. He sought immediate release under reasonable conditions of supervision through an emergency motion for temporary restraining order. On August 4, 2026, the federal court granted his motion and ordered his immediate release, finding he demonstrated a likelihood of success on the merits of his due process claim under the Mathews v. Eldridge test and that he would suffer irreparable harm from continued unlawful detention.

Father of Four Dies After Medical Negligence in Adelanto ICE Facility
