Journalist detained over two months after filming ICE agents amid DHS 'violence' claims

Sep 9, 2025Long Beach, CA

The Department of Homeland Security has said that filming and posting videos of ICE agents constitutes "violence" and threatened to prosecute people who record agents during operations. DHS Assistant Secretary Tricia McLaughlin called such recording "doxing," echoing Secretary Kristi Noem's earlier statement that videotaping or doxing agents qualifies as violence against them. Georgia-based journalist Mario Guevara, who has legal work authorization, has been held in ICE detention for more than two months after he was targeted for recording enforcement operations. When asked to substantiate claims of a sharp rise in violence against agents, DHS cited examples such as trash dumped on an agent's lawn and a sign bearing a profanity, and an ACLU attorney representing injured journalists and legal observers in Los Angeles disputed the department's violence statistics.

Lorena Pineda, a 27-year-old Salvadoran mother of two, was arrested by ICE agents on June 19, 2025, while five months pregnant at a food stand in California. Despite ICE policy prohibiting detention of pregnant women for administrative violations, an agent told her he would not release her. She was transferred through multiple detention facilities—Los Angeles, San Bernardino, Atlanta, Alexandria, and finally South Louisiana ICE Processing Center in Basile, Louisiana—where she was held for over 3.5 months separated from her young children by 1,500 miles. At the facility, she was housed with at least 20 other pregnant women and witnessed multiple miscarriages, including a woman carrying twins. She received inadequate prenatal care, poor nutrition, and was unable to contact her family for the first month. Salvadoran man freed after judge rules months-long ICE detention violated due process

Aug 27, 2025San Diego, CAEl Salvador

David Antonio Aviles Perez, a 35-year-old Salvadoran national known as 'La Bruja,' was arrested by ICE in San Diego on March 26, 2025, and held at Otay Mesa Detention Center for nearly five months without a bond hearing. U.S. District Judge Jinsook Ohta ruled on August 26, 2025 that immigration officials violated his Fifth Amendment rights by failing to make an individualized assessment of danger or flight risk, ordering his release and barring re-detention unless an immigration judge independently finds it warranted. In December 2025, a court in El Salvador convicted him in absentia of aggravated murder for a July 2014 killing in La Union and sentenced him to 20 years. Homeland Security Secretary Markwayne Mullin publicly criticized Ohta as an 'activist judge,' saying her ruling released a 'wanted murderer.'

Guatemalan father detained 9 months wins release after immigration judge failed to justify continued detention

Aug 26, 2025Los Angeles, CAGuatemala

A Guatemalan father of three, a native and citizen of Guatemala, has resided in Los Angeles with his family for many years and has three biological children who are United States citizens. He was arrested by immigration authorities on August 26, 2025, and has been detained at the Adelanto ICE Processing Center since that time. He is pending removal proceedings and is seeking Cancellation of Removal relief. An immigration judge denied bond at two hearings—one on January 12, 2026 (where he bore the burden of proof) and another on March 2, 2026 (where the government bore the burden)—based solely on his prior DUI conviction and immigration history, without adequately considering his family ties, stable residence, or lack of criminal history involving moral turpitude. The federal magistrate judge found the March 2, 2026 bond denial was an abuse of discretion because the immigration judge failed to conduct an individualized assessment, consider mitigating factors, or address alternatives to detention as required by the Rodriguez class action injunction. The court ordered his immediate release on his prior conditions of supervision and enjoined further detention without a compliant bond hearing.
