He was arrested without a warrant and has not been presented with one. He filed a habeas corpus petition and application for temporary restraining order challenging the lawfulness of his warrantless arrest under 8 U.S.C. § 1226(a) and § 1357(a)(2). On August 7, 2026, the federal court granted his petition, finding that his warrantless arrest was unlawful because no statutory exception applied. The court ordered his immediate release and converted his temporary restraining order application into a preliminary injunction, also waiving bond requirements.

Sebastian Mihai Caraba, a Hungarian-Romanian national, was arrested by ICE on June 10, 2026, in Washington, D.C. for overstaying his visa and alleged credit card fraud. Caraba entered the U.S. on August 11, 2018, under the Visa Waiver Program via San Juan, Puerto Rico, and had previously visited the U.S. twice under the same program, departing within the authorized period each time. He was wanted in Fairfax, Virginia for illegal use of credit cards and had been convicted abroad for similar credit card fraud, receiving a three-year prison sentence. Joel, a 25-year-old landscaper and father of a 10-month-old U.S. citizen daughter, was detained by ICE in an unmarked vehicle stop while en route to work. He was held for five days in an unapproved Baltimore detention facility where he reports being denied food and water and forced to sleep on the floor. He was subsequently transferred through Pennsylvania, Louisiana, and back to Pennsylvania before being deported to Guatemala without opportunity to say goodbye to his daughter, leaving his 22-year-old partner and infant child without income or support.

Edvin Obdulio Barnica-Esquivel was arrested by ICE agents at Danbury Superior Court on June 22, 2026, on a federal charge of illegally reentering the United States after prior deportations. According to federal records, Barnica-Esquivel had been deported to Guatemala twice previously (in 2012 and 2019) and had recent local arrests in Danbury for assault and arson-related charges. A Mexican national who has resided in the United States for over 30 years and is married to a U.S. citizen with four U.S. citizen children was arrested at a McDonald's in Fontana, California on June 20, 2026 pursuant to a Warrant of Arrest (I-200). He had been removed to Mexico in 2001 but reentered without authorization. ICE reinstated his prior 2001 removal order and provided him written notice on Form I-871 on the date of arrest. A Venezuelan woman with active Temporary Protected Status was arrested and has remained detained at Eloy Detention Center for nearly nine months. Court filings show a federal government attorney acknowledged her legal status, yet she continues to be held in custody.

Franklin Humberto Coral-Garrido, a Colombian activist and lawyer aligned with President Gustavo Petro, was detained by ICE on June 16-17, 2026, in Phoenix, Arizona while walking with his 12-year-old son. Coral entered the U.S. in December 2015 on a B1/B2 tourist visa valid for six months but remained in the country for approximately ten years. Tuan Phan, a 44-year-old Vietnamese national, was deported to South Sudan in July 2025 by the Trump administration under a third-country deportation program. He was released the same day with an ankle monitor. This is the fourth Upstate Medical University worker detained by ICE in the last year, according to union officials.

Joyce Basele, a 64-year-old nursing assistant from Kenya who entered the U.S. legally in 2005, was detained by ICE on June 18, 2026, during a routine check-in at a Houston ICE field office. For 14 years, Basele had complied with required immigration check-ins while under an order of supervision with a final removal order in place. She has no criminal history, pays taxes, works as a certified nursing assistant caring for children and elderly adults, and has a U.S.-citizen daughter whose petition to sponsor her mother was approved. Investigators located and arrested Bautista on June 18 during a targeted operation. He was charged with felony aggravated battery on a law enforcement officer. ICE officers and Florida Highway Patrol conducted a vehicle stop on June 18, 2026, near Americana Boulevard and Pointe Vista Circle. During the stop, Elias Bautista, a 23-year-old from Mexico, fled on foot and physically resisted apprehension. Bautista struck an ICE agent, causing a significant head injury, before fleeing the scene. He was apprehended days later and charged with felony aggravated battery on a law enforcement officer.

A long-term law-abiding resident of the United States, a noncitizen, was detained at the Western Tennessee Detention Facility pending removal proceedings without receiving a bond hearing. He filed a Petition for Writ of Habeas Corpus challenging his detention as violating due process rights. The court noted that he, described as a long-term law-abiding resident of the United States, had been held in mandatory detention. Following the Sixth Circuit's decision in Lopez-Campos v. Raycraft, which established that noncitizens are entitled to a bond hearing under 8 U.S.C. § 1226(a), the respondent agreed that a custody redetermination hearing was required. The district court granted the habeas petition to the limited extent of ordering that he receive a bond hearing within ten days or be released from custody, finding that Section 1226 guarantees only a hearing opportunity, not automatic release.

Jessica Trevino, a 34-year-old DACA recipient who arrived in the U.S. from Mexico at age six or seven and has lived in Texas her entire life, was arrested by ICE agents on December 28, 2025, as she left church with her family in the Rio Grande Valley. Agents rammed the family's vehicle in a Home Depot parking lot, struck her husband Juan with a baton, and shoved her 14-year-old daughter Sarah against the car hard enough to bruise her. Trevino's DACA status was valid and not set to expire until spring 2027. She worked in an elementary school cafeteria and had no criminal record. After nearly 90 days in ICE custody, an immigration judge granted voluntary departure; Trevino claims she did not consent to this order and did not sign the forms. A Mexican national who fled Mexico in 2024 due to extortion threats and entered the U.S. without inspection was detained by ICE on June 18, 2026, pursuant to a warrant issued June 8, 2026. He had arranged for his young son to join him in the U.S., and the son was detained by immigration authorities upon entry in January 2026 before being released to his father's care as ORR sponsor. During the June 18 detention, approximately five vehicles surrounded the father and his son as they left their home; agents pointed guns and arrested him while his son remained in the vehicle. His nephew Christopher, a U.S. citizen, launched an extensive search using ICE's online tracker and contacted federal authorities, eventually working with legal aid group ImmDef to locate Daniel at Adelanto detention center. Daniel ended up in a hospital in Tijuana with no awareness his family was searching for him. After more than nine months, lawyers secured his parole and return to the U.S. A federal judge subsequently issued a temporary restraining order blocking ICE from detaining him if he returns, ruling that his deportation raised serious due process concerns.

All detainees at the South Florida Detention Center, a facility in Florida's Everglades known as "Alligator Alcatraz" that opened in July 2025, were transferred to other facilities in mid-June 2026. The U.S. Department of Homeland Security cited hurricane season safety concerns as the reason for the transfers.
