Detainee at Adelanto seeks TRO blocking transfer out of California pending habeas case

The petitioner was arrested in Florida on September 23, 2024, in connection with a pending criminal matter and was taken into ICE custody on November 28, 2024. ICE subsequently transferred him to California, where he is currently detained at the Adelanto ICE Processing Center. An Immigration Judge in his removal proceedings advised him to resolve his pending Florida criminal case before pursuing cancellation of removal. On March 24, 2025, a Florida state court judge ordered him transported to Indian River County, Florida, to face pending charges, but ICE has not carried out that transfer. He filed a habeas petition and an ex parte application for a temporary restraining order seeking to prevent ICE from transferring him outside the Central District of California while his habeas petition is pending. The court denied the TRO application without prejudice, finding he had not shown any imminent plan by ICE to remove him from the district and had not shown why the General Order's expedited briefing schedule and two-day removal notice requirement were insufficient to address his concerns.
