A federal judge ordered ICE to release Elisthene Petit Kat, a 38-year-old Haitian man living in Springfield, Ohio, or give him a bond hearing, rejecting the agency's claim that he is subject to mandatory detention as an 'arriving alien.' Petit Kat, who fled violence in Haiti with his partner and daughter, was paroled into the U.S. in 2023, worked at an auto parts factory, attended church regularly, and supports a son still in Haiti; he was arrested during a traffic stop in Clark County after local police working with ICE pulled over the vehicle he was riding in. At least five other Haitian nationals — Darline Jean Baptiste, Peterson Nozil, Jean Alix Comper, Paulson Saintelien, and Jodas Etienne — have filed similar habeas corpus petitions challenging their detention without bond at the Butler County Jail, with some arrested while driving home, returning from work, or elsewhere in the Springfield area. The U.S. Supreme Court has agreed to review the legality of the Trump administration's mandatory detention policy, which nine of thirteen federal appeals courts have already ruled unlawful.
