DHS Third Country Deportations Challenged in D.V.D. v. DHS

The U.S. Department of Homeland Security has escalated efforts to remove individuals with final removal orders to third countries without meaningful notice or opportunity to seek protection. On February 25, 2026, the U.S. District Court for the District of Massachusetts issued a summary judgment decision in the nationwide class action D.V.D. v. DHS, setting aside DHS' third-country removal policy. The decision has been stayed by the First Circuit pending an expedited appeal.
