U.S. District Judge Kyle Dudek, a Trump appointee, ordered his release within 48 hours in May 2026, ruling the government failed to show removal was reasonably foreseeable under the Zadvydas standard. Dudek noted the government did not respond to the court's request for evidence on removal efforts, writing, "The Government's response? Crickets. Nothing was filed."
