Samantha, a young lesbian woman from Honduras, fled severe physical and sexual violence inflicted because of her sexual orientation. After attending an immigration check-in in Chicago, she was detained and transferred to a county jail in Missouri that contracts with ICE, separating her from her legal counsel and support network. The government sought to pretermit her asylum case and remove her to Ecuador, Guatemala, or Uganda. Her attorneys submitted evidence documenting anti-LGBTQ violence in all three countries, including expert testimony regarding the likelihood of persecution and torture she would face in Ecuador. While the immigration judge considered the transfer, Samantha remained detained with deteriorating mental health. Ultimately, rather than continue enduring detention and the threat of transfer to another dangerous country, she withdrew her request for admission and accepted removal to Honduras — the country she had fled.
