The petition alleges the arrest was made without a judicial warrant and that the facility lacks basic amenities such as proper bedding, despite the family's ties to Billings, where the parent has lived for four years and the child for three years while attending elementary school. The child has upcoming medical appointments, including bloodwork and an ultrasound, that took months to schedule. The U.S. Attorney's Office acknowledged the warrantless arrest but argued releasing the parent and child would not be appropriate, while attorneys are seeking their immediate release or a bond hearing as part of a broader case alleging the government is unlawfully detaining 17 people at the Cascade County Detention Center.

Jesus Verde Hernandez, a Worden man who has lived in Montana for 10 years with his partner of 14 years and three young children, was arrested on July 30 by Customs and Border Patrol without a warrant or probable cause while agents searched for another man they said resembled him. He was transported between Lewistown, Jordan, Malta, Havre, and Great Falls over 30 hours and held in the Cascade County Detention Center. Federal authorities attempted to coerce him into self-deporting himself. Chief District Judge Brian Morris ordered his release, finding the detention violated his constitutional rights and that the government had no statutory authority to detain him. The judge rejected the government's argument that Hernandez must exhaust administrative remedies, saying the process was "deficient from the outset." His attorneys at Upper Seven Law are seeking class certification, identifying 17 people similarly unlawfully detained in the same facility.

On July 1, 2026, Bozeman resident Brandi Straub was driving near Camp Equinox summer theater camp when ICE agents conducting enforcement operations pursued suspects across the street. An ICE agent pointed a gun through Straub's passenger side window as she braked to avoid an enforcement vehicle. Straub's 12-year-old daughter and a neighbor's 11-year-old were attending the camp, located three blocks away with approximately 120 children present. When Straub called 911 to alert authorities to the nearby ICE operation, dispatch informed her that local police could not intervene in ICE operations. The school had not been informed of the enforcement activity taking place in the area.

David Cortes-Torres, a 20-year-old man and primary caregiver for his grandmother who is undergoing cancer treatment, was detained by ICE agents in Bozeman on Monday. According to a federal habeas corpus petition filed by Upper Seven Law, agents held him for more than 24 hours at Helena Airport in a small holding room with over 15 other people, pressured him to voluntarily leave the country, and limited his attorney contact to a single three-minute phone call. His lawyers allege the arrest was part of an operation targeting Latinos in the area, and a federal judge ordered him to remain in Montana pending a hearing set for the following Tuesday.

ICE conducted multiple operations throughout the week of June 29 around Bozeman and Gallatin Gateway, detaining approximately 150 residents according to nonprofit Bienvenidos a Gallatin Valley, though other estimates put the number around 100. Following the arrests, fear gripped the local Latino community; many residents stopped leaving their homes entirely out of fear of arrest, and Latino business employees with valid visas ceased working. In response, Bienvenidos a Gallatin Valley organized emergency deliveries of groceries, toiletries, diapers, infant formula, and other household supplies to nearly 160 households across Gallatin County between June 26 and July 7.

Jose David Cortes Torres, a 20-year-old noncitizen who has lived in Bozeman since 2023, was pulled over on June 29 while driving to work by ICE agents in an unmarked white Dodge Durango. According to court documents, agents asked for his driver's license, told him he had no right to be in the United States, and arrested him without charging him with a crime. He was detained for more than 24 hours in a holding room at the Helena airport with more than 15 other individuals, forced to stand for approximately six hours due to cramped conditions, and was limited to a single three-minute phone call with attorneys. He was told to voluntarily self-deport or face months of lockup. His lawyers at Upper Seven Law filed a habeas corpus petition in federal court alleging the arrest violated constitutional due process rights and was part of a dragnet operation targeting Latinos based on race and language, without individualized suspicion. Cortes Torres is the primary caretaker for his grandmother, who is undergoing cancer treatment.

Roberto Orozco-Ramirez, a diesel mechanic from Froid, Montana, was arrested by Border Patrol on January 25, 2026, on illegal re-entry charges. After the government dropped the felony charge in April 2026, he remained detained for over 100 days under the Trump administration's expanded mandatory detention policy for undocumented immigrants. On May 14-15, 2026, U.S. District Court Chief Judge Brian Morris ruled that Orozco-Ramirez's continued detention violated due process and constitutional rights, finding the administration's mandatory detention interpretation erroneous. The judge ordered his immediate release from the Cascade County Detention Center. Orozco-Ramirez, a father of four U.S. citizen children with no criminal record, had built a successful diesel repair business after living in the United States for 25 years.

Roberto Orozco-Ramirez, an undocumented Mexican immigrant and longtime Froid, Montana resident, turned himself in to Border Patrol on January 25, 2026, after agents staked out his home. He was charged with illegal reentry and held in detention. After the government dropped the illegal re-entry charge in April, he remained in custody under the Trump administration's expanded mandatory detention policy. On May 14, U.S. District Court Chief Judge Brian Morris ruled his continued detention unlawful, finding the administration's interpretation of immigration law erroneous and violating due process rights, and ordered his release within 24 hours. The small, conservative town of Froid organized community fundraisers to support his family throughout the ordeal.

Wualter Jesus Travieso Soto, 29, was arrested February 1, 2025, and charged with felony sexual intercourse without consent with a child under 16 after the victim's aunt obtained guardianship and the girl reported multiple assaults. Soto, who entered the U.S. without authorization in 2023, remains in Flathead County jail on $200,000 bail with an ICE detainer. He pleaded not guilty at his April 9 arraignment, with his next court date scheduled for August 3, 2026.

Jose Eliezer Martinez-Andino, a 20-year-old mechanic living in Raleigh, North Carolina, and father to a U.S.-citizen daughter, was stopped by Border Patrol agents in Montana in March 2026 while riding in a car with a forged license plate. He had entered the U.S. in 2020 as an unaccompanied minor and held Special Immigrant Juvenile Status, deferred action, and a work permit, with his removal proceedings previously dismissed by a judge. Despite this status, he was pressured into signing a voluntary-departure form, moved between at least six detention centers, denied contact with his attorneys for more than ten days, and deported to Honduras in April after his attempts to revoke the agreement were allegedly ignored. U.S. District Judge Beryl Howell found the removal was carried out "in a manner that boggles the mind" without due process and ordered the government to facilitate his return along with his daughter. He was flown to Harlingen, Texas in August but remained in CBP custody as DHS filed a new removal case against him.

ICE Homeland Security Investigations Kalispell, with support from Spokane Border Patrol, conducted a worksite operation at a construction site in Bigfork on March 4, 2025. Acting on a tip, agents served a notice of inspection and encountered 17 undocumented immigrants. All 17 were taken into custody and found ineligible to remain in the United States.

Duran Valdivias, a Mexican citizen working for a local property manager, was arrested by ICE agents on February 13 after a Great Falls Police Department detective called an ICE agent to a suspected trespassing scene. According to court documents, ICE discovered that Valdivias had been detained by U.S. Customs and Border Patrol five times in 2012 and had been ordered to stay out of the country.
