Honduran land surveyor and father of US-citizen twins fights ICE bid to revoke deferred status and detain him

A Honduran man who has lived in the United States since he was ten years old, now more than twelve years, sought emergency court protection after ICE threatened to detain him. He is the father of twin daughters who are US citizens and has been in a relationship with their mother, a US citizen, for over six years, serving as the family's sole financial provider while she stays home with the children. He has worked lawfully as a land surveyor for two years and is training to supervise his own crew. His asylum and withholding of removal claims were denied in 2022 and remain on appeal before the Board of Immigration Appeals, but in 2023 USCIS approved his Special Immigrant Juvenile petition and granted him deferred action valid through August 2027, along with work authorization. A 2022 arrest on child cruelty and vandalism charges resulted only in a misdemeanor vandalism conviction after a charge reduction. On August 1, 2026, ICE ordered him to report for a check-in at the Santa Maria field office on August 18, and an ICE officer told his attorney he had asked USCIS to terminate the man's deferred action so he could be detained at that appointment. He filed a habeas petition and a request for a temporary restraining order the day before the check-in, arguing he was entitled to a hearing before any re-detention. The court granted the TRO, barring ICE from detaining him without a prior hearing and, if he had already been detained at the August 18 check-in, barring his removal or transfer out of the district while the case proceeds.
