Guatemalan man re-detained by ICE moments after judge ordered his release

Ivan, 27, a construction worker from Guatemala who has lived in the U.S. since 2019 and has no criminal record besides minor traffic violations, was granted release from immigration detention after a federal judge approved his habeas petition. As he walked toward the doors of the Whipple Federal Building hoping to visit a church and see his wife, five federal agents immediately handcuffed him and took him to Freeborn County Jail. His attorney, Steven Appelget, had argued in the habeas petition that agents lacked probable cause or a warrant when they initially arrested Ivan at a gas station and followed him to a Menards parking lot in Columbia Heights before detaining him.
