Eddysont D.: Haitian man with TPS held after ICE arrest in Florida
A Haitian man with legal work authorization through 2030 was arrested by ICE in Florida and flown to a California detention facility; a judge ordered his release, citing due process violations.

A Haitian man was paroled into the United States in August 2022 and later received Temporary Protected Status, asylum application pending, and employment authorization allowing him to lawfully live and work in the country until July 2030. On September 21, 2026, ICE officers arrested him in Palm Beach, Florida and transferred him across the country to the Desert View Annex Detention Facility in Adelanto, California, where he remained held. He was given no notice and no opportunity to be heard before a neutral decisionmaker, despite his valid parole, TPS, and work authorization. His attorneys argued the Department of Homeland Security had not lawfully terminated his parole before detaining him. A federal judge found he was likely to succeed on his claim that his detention violated his Fifth Amendment due process rights and ordered Respondents to release him within 24 hours, barring re-detention without individualized notice and a bond hearing.
