Carlos F.C.: Venezuelan man re-detained after traffic stop, held without a bond hearing

A Venezuelan man paroled into the U.S. in 2024 was detained after a traffic stop and denied a bond hearing. A federal judge ordered one within seven days or his release.

Oct 15, 2026Baker, FLCountry of origin: Venezuela

A Venezuelan man was paroled into the United States on August 7, 2024. On July 13, 2026, local authorities arrested him following a traffic stop, and the next day ICE took him into custody. He asked for a bond hearing, but an immigration judge ruled the court had no jurisdiction to hold one, leaving him detained at the North Florida Detention Facility in Baker, Florida with no way to ask for release. On September 28, 2026, he filed an emergency habeas petition on his own, without a lawyer, asking the federal court in Jacksonville for release or a bond hearing. On October 15, 2026, Judge Marcia Morales Howard granted the petition, ruling that because he was paroled into the country and re-detained years later, not seeking entry at the border, his detention without an individualized bond hearing violated the Immigration and Nationality Act. She ordered the government to give him a bond hearing within seven days or release him.
