Apolinario P.L.: Guatemalan man held months by ICE without bond hearing

A Guatemalan man was detained after a traffic stop and held for months with no hearing. A judge ordered his release, ruling the lack of any hearing violated due process.

Sep 28, 2026FloridaCountry of origin: Guatemala

A man from Guatemala was pulled over during a traffic stop in July 2026 and taken into ICE custody. He was never given an initial custody determination by an immigration officer or the opportunity to demonstrate that his release would not pose a danger or flight risk, as required before detention under the relevant immigration detention statute. Months later he remained locked up with no hearing ever having taken place, even though the government argued he could belatedly request a bond hearing. A federal judge ruled that the complete failure to provide any pre-detention hearing violated due process and ordered his immediate release, also barring the government from re-detaining him without first giving him notice and a hearing before an immigration judge.
