Oleg T.: 25-year-old Russian contractor held by ICE a month without bond hearing

Sep 4, 2026Post Falls, IDCountry of origin: Russia

A 25-year-old Russian contractor entered the U.S. lawfully on a visa in 2017 as a minor, traveling with his father. His visa expired in January 2018, but before it did, his father filed an asylum application listing him as a derivative beneficiary; that application has been pending for over eight years. He holds a work permit valid until 2030, has no criminal record, and was working as a contractor before his detention. Earlier in 2026 his father returned to Russia, where his mother and sister still live. On September 4, 2026, he was taken into ICE custody after being found sleeping at a truck stop in Post Falls, Idaho, and was later transferred to the Golden State Annex Detention Facility in California. He was held for more than thirty days without receiving a bond hearing despite requesting review by an immigration judge. He filed a habeas petition and motion for a temporary restraining order arguing he was detained without due process, and a federal judge granted the petition, ordering his immediate release and barring re-detention absent a hearing where the government proves by clear and convincing evidence that he is a flight risk or danger.
