A Guatemalan man entered the United States without inspection in 2012 as a minor and has lived continuously in the country for about 14 years. He owns and operates his own nursery business in Homestead, Florida, and has no criminal history. On August 14, 2026, he was detained by ICE agents while driving home from work; he was not engaged in any wrongdoing at the time. He requested a custody redetermination hearing at the time of his arrest, but did not receive that hearing before an immigration judge until September 22, 2026, roughly six weeks later, and the hearing resulted in denial of bond. He has remained in ICE custody at the Golden State Annex Detention Facility since his arrest. He filed a habeas petition and motion for a temporary restraining order arguing the delay in his custody hearing, among other things, violated his due process rights. The district court found his initial detention was lawful under immigration statute but ruled that the six-week delay before his bond hearing violated due process, and ordered his immediate release, return of his belongings, and a prompt new bond hearing if the government seeks to re-detain him.
