Francisco P.B.: Young man re-detained by ICE after juvenile case completed
A young man previously released on parole was taken back into ICE custody right after finishing a juvenile court commitment, held without a hearing before being freed by a federal judge.
Jun 18, 2026
A young man had previously been released into the United States on bond or conditional parole. After completing a commitment stemming from a juvenile delinquency adjudication in 2024, he was taken back into ICE custody on June 18, 2026, the day after finishing that commitment. The government never gave him a hearing before re-detaining him, relying instead on his past juvenile case as justification. He was held at the Central Valley Annex ICE Detention Facility while his habeas petition challenged the legality of his re-detention. The court found that due process requires a hearing before a neutral decision-maker before someone who was already living in the community can be locked up again, and that the government had not explained why his past case changed that rule. Because officials failed to show any valid reason to keep him detained without a hearing, the judge ordered his immediate release, with the government required to give seven days' notice and hold a proper hearing before trying to detain him again.
