Pedro M.M.: Man re-detained by ICE 11 years after release on bond

A man held by ICE since 2015 under bond was re-detained during a 2026 traffic stop without notice or a hearing. A judge ordered his immediate release, citing due process violations.

Sep 4, 2026California City, CA

The man entered the United States on an unknown date and was detained by U.S. Border Patrol in January 2015, then placed in removal proceedings. He was released on bond in April 2015 and remained free for more than a decade. On September 4, 2026, he was re-detained by ICE following a traffic stop, without a warrant and without being given notice or a chance to be heard beforehand. The government conceded there were no facts distinguishing his case from prior cases the court had ruled on, but argued a bond hearing was the appropriate remedy given his criminal history. The court rejected that argument, finding he had a liberty interest in his continued release on bond and that re-detaining him without notice or a hearing violated due process. The judge ordered his immediate release on his prior bond conditions and barred the government from re-detaining him again without providing notice and a hearing before an immigration judge.
