Edzer T.: Man redetained by ICE despite earlier release on parole

A man previously released into the U.S. on parole was redetained by ICE without a bond hearing. A federal judge ordered his immediate release, finding the government violated his due process rights.

Sep 15, 2026California City, CA

A man who had previously been released into the United States—on bond, conditional parole, or humanitarian parole—before immigration authorities took him back into custody. The government claimed he had developed a criminal history since his entry, but officials never explained how that history justified re-detaining him without a hearing. He was taken into ICE custody on September 15, 2026, and held at the California City Detention Facility. The government argued his detention was mandatory under one statute, but the court found it was instead a discretionary matter requiring review. Because he had already been living in the community after release and was given no hearing before a neutral arbiter before being locked up again, the court found his re-detention violated due process. The judge ordered his immediate release, directed the return of his personal documents and belongings, and ruled that if the government wants to redetain him in the future, it must give seven days' notice and hold a proper bond hearing first.
