Martina I.R.A.: Woman detained by ICE for months with no bond hearing

A woman who had quietly built a settled life in the country for years was detained by ICE in July 2026 without any hearing, and a federal court ordered her immediate release.

Oct 13, 2026California City, CA

A woman was admitted to the United States in November 2022 on a visa that was valid through January 31, 2023, and she remained in the country after it expired. She was taken into ICE custody in July 2026, more than three years after her visa lapsed, and held at the California City ICE Detention Facility. During that time she was never given notice or a hearing before a neutral judge to argue for her release on bond. A federal district court found that because she had developed a settled, uncontested life in the country before being detained, due process required the government to provide her a pre-deprivation bond hearing before taking her into custody, which it failed to do. The court ordered her released immediately under the same conditions she lived under before her detention, with her documents and belongings returned to her, and ruled that if the government wants to detain her again it must give seven days' notice and hold a bond hearing first.
