Wilfredo A.M.C.: Nicaraguan asylum seeker detained by ICE at routine check-in

A Nicaraguan asylum seeker who lived in the U.S. nearly five years with no criminal history was re-arrested by ICE at a routine check-in; a judge ordered his immediate release, citing unproven violation claims.

A Nicaraguan man came to the United States in December 2021 and was released by immigration authorities on his own recognizance after being encountered at the border. He has a pending asylum application and no criminal history, and lived in the community for nearly five years while his case proceeded. On August 5, 2026, ICE arrested him when he showed up for a scheduled check-in appointment, claiming he lacked lawful status and had violated the terms of his release. He was then held at the Golden State Annex Detention Facility in McFarland, California. The government never provided any specifics about the alleged violation, such as dates, records, or a sworn statement from an officer, relying only on a brief notation in an arrest report. A federal judge found his re-detention without advance notice or a hearing violated his due process rights and ordered his immediate release, also barring the government from detaining him again without seven days' notice and a bond hearing.
