Jose S.C.V.: Ecuadorian man detained by ICE with no probable cause shown

An Ecuadorian man with no prior immigration record was arrested during an ICE raid on a Rochester home and held four months before a judge ordered his release over due process violations.

Jun 12, 2026Rochester, NYCountry of origin: Ecuador

An Ecuadorian man who entered the United States without inspection in April 2019 and had no prior interactions with immigration authorities before this case was arrested by ICE officers on June 12, 2026, while they executed a federal search warrant targeting a Rochester, NY home for harboring undocumented immigrants; two others were also detained at the scene, one of whom was released after being confirmed lawfully present. He has since been held at the Central Valley Annex Detention Facility, and in September an immigration judge denied his release, finding him a flight risk. The federal court found that ICE did not issue his notice to appear until two days after his arrest, violating regulations requiring that notice to precede any arrest warrant. The court also found that the arrest warrant itself failed to check any box indicating a basis for probable cause that he was removable, violating his due process rights. The judge ordered his immediate release from custody.
