Israel I.P.: Mexican asylum seeker re-detained at ICE check-in in Fresno

A Mexican asylum seeker who lived in Fresno with his mother and sister for two years, with no criminal record, was arrested at a scheduled ICE check-in. A judge ordered his immediate release, finding the government's violation claims unproven.

A man from Mexico first entered the United States in 2003 and was voluntarily returned, then re-entered in 2023 before returning again in May 2024 through a scheduled CBP One appointment, where he claimed a credible fear of returning to Mexico and sought asylum. He received a positive asylum determination and was placed into standard removal proceedings, which remain ongoing. For more than two years he lived in Fresno, California with his mother and sister, held a valid driver's license and work permit, attended monthly in-person ICE check-ins and weekly facial-recognition check-ins, had no criminal history, and was an active member of his church, whose pastor wrote a letter of support for him. In August 2026, ICE required him to appear for a check-in scheduled outside normal office hours; when he arrived with his sister, agents denied her entry, placed him in a holding cell, and arrested him after he refused to sign documents, transferring him to the Golden State Annex Facility in McFarland, California, where he remains. ICE cited six alleged compliance violations between July 2024 and January 2026 to justify the arrest, but provided no supporting records, and he disputes the allegations. The judge found that his re-detention after more than two years of compliance violated due process and that the government's unsupported allegations appeared pretextual, ordering his immediate release and requiring advance notice and a bond hearing before any future detention.
