Mario Mata Cruz, a Salvadoran national with pending green card status and no criminal record, was arrested by ICE on Long Island in October 2025 while driving to work with his brother. He had obtained Special Immigrant Juvenile (SIJ) status in 2019 after crossing the border at age 17, putting him on track for a green card. ICE transported him to a detention facility in Texas and subsequently deported him to El Salvador without a final removal order from an immigration judge—a process his lawyer, Ed Cuccia, says is illegal. Nearly six months after his deportation, Mario remains in El Salvador while his green card application, which could have been approved, remains pending. The case is part of a broader pattern documented by NY1 of at least 132 cases where people were deported without final removal orders and received those orders after already being removed.
