Howell wrote that a memo from acting ICE Director Todd Lyons defined "escape risk" so broadly that nearly anyone encountered by officers could be deemed arrestable, noting the memo dropped language limiting the standard to whether a person was likely to be found at the scene or another identifiable location. The judge said the policy amounted to word games aimed at maintaining ICE's arrest rate despite prior court rulings. Advocacy groups CASA and ACLU had previously documented 33 cases of continued warrantless arrests after the original injunction.
