Mexican national detained without bond after Eighth Circuit denies habeas petition
Aug 29, 2025 · Minneapolis, MN, Mexico

Joaquin Herrera Avila, a Mexican national, was detained in Minneapolis by ICE without bond after failing to produce legal credentials. A lower court in Minnesota had granted his habeas petition, but the Eighth Circuit Court of Appeals overturned that decision, ruling that immigrants in removal proceedings are not entitled to bond hearings and can be held in mandatory detention without judicial intervention.
