A 19-year-old Guatemalan citizen who has lived in the United States since entering as a 10-year-old with his father in January 2018 was arrested by ICE on August 1, 2026, two blocks from his home in Port Chester, New York, while returning from dinner, along with three other individuals. He has no criminal record and had never previously been the subject of any immigration enforcement action. An immigration judge had ordered him removed in absentia on July 22, 2019, when he was only twelve years old, but he alleges he never received notice of that hearing and was unaware of the proceedings. He was not detained or contacted by immigration authorities at any point between the 2019 order and his 2026 arrest. He is currently detained, having been moved between the Metropolitan Detention Center in Brooklyn and Delaney Hall Detention Facility in New Jersey. He filed a habeas petition seeking immediate release, arguing the government lacked statutory authority to detain him years after the 90-day removal period following his removal order expired. The court found he was likely to succeed on the merits and issued a temporary restraining order directing his release from custody and barring his re-detention pending further review.
