Sergio Alberto Barco Mercado sued the Department of Homeland Security and other officials over conditions at ICE's 26 Federal Plaza facility in Manhattan, alleging detainees were held in overcrowded hold rooms for extended periods with inadequate sleeping conditions, unsanitary environments, denial of personal hygiene and privacy, and insufficient food and water. A federal judge in the Southern District of New York granted a permanent injunction and certified a class action on behalf of detainees processed through the facility's hold rooms, finding that ICE had eliminated effective limits on hold room conditions amid a surge in arrest volume.
