A man who entered the United States in 2016 lived at liberty in the country for almost ten years before immigration authorities detained him on September 24, 2026. He is now held at the ERO El Paso Camp East Montana facility while his removal proceedings remain pending. He filed a petition arguing that his continued detention without an individualized custody or bond hearing violates his statutory and constitutional due process rights, asking for release or at least a bond hearing. He also asked the court to block his transfer out of the district or his removal from the country while his case is reviewed. The judge found his case appeared similar to other cases where she had already found due process violations and ordered immigration officials to explain by October 15, 2026 why his petition should not be granted. While declining to issue an immediate restraining order, the court barred his removal from the United States or transfer out of the El Paso district until further order.
