Abubakar I.: Man facing deportation to Sierra Leone wins transfer block
The petitioner, detained by U.S. Immigration and Customs Enforcement, filed a habeas corpus petition challenging his detention.
Sep 24, 2026Country of origin: Sierra Leone
The petitioner, detained by U.S. Immigration and Customs Enforcement, filed a habeas corpus petition challenging his detention. He asked the court to block his transfer out of the Central District of California, to prevent his removal to Sierra Leone or any third country without a full hearing on withholding of removal and Convention Against Torture protection before a neutral adjudicator, to order his immediate release, and to issue an order to show cause on a preliminary injunction. Respondents had not responded to the application at the time of the order. The court found good cause to partially grant the request, ordering that the petitioner not be removed from the United States during the pendency of the habeas proceedings. The court also ordered that he not be transferred outside the district, citing his interest in participating in the proceedings and maintaining access to legal counsel. The court denied the remaining requests, including immediate release, finding no imminent irreparable harm that could not be addressed through normal or expedited briefing.
