Mohammed Hoque, a 20-year-old international student from Bangladesh studying at Minnesota State University Mankato, was arrested by immigration agents outside his apartment on March 28. DHS claimed he was a public safety threat due to a 2023 misdemeanor disorderly conduct conviction, though no one was hurt in the underlying incident and immigration authorities had allowed him to reenter the U.S. after questioning him about it in 2023. Hoque alleged he was targeted because of his outspoken support for Palestinian human rights, and U.S. District Judge Jerry Blackwell ordered his release, finding his First Amendment claim 'clear on the law and on the facts' and that DHS had presented no evidence justifying his arrest and continued detention. Hoque's attorney, ACLU-Minnesota Legal Director Teresa Nelson, said he spent 40 days in custody that he 'can't recoup.'
