A native and citizen of India fled his home country and entered the United States on April 15, 2023. He was immediately released from custody, moved to the Los Angeles area, timely filed an asylum application, and complied with every condition of his release. He has no criminal convictions and has a supportive network in the U.S., including a cousin. Although an immigration judge dismissed his removal case in 2023, his asylum application remained pending with USCIS. More than three years later, on October 6, 2026, DHS/ICE agents re-arrested him in Fontana, California, and transferred him to the Adelanto Detention Facility. He was given no written notice explaining the reason for his re-detention, no assessment of whether he posed a flight risk or danger, and no hearing before a neutral decisionmaker. A federal magistrate judge granted his habeas petition, finding the government's lack of opposition and the due process violations warranted immediate release, and barred his future re-detention unless the government first proves by clear and convincing evidence that he is a danger or flight risk, or that his removal is significantly likely in the near future.
