A Venezuelan man who entered the United States in October 2022 was released on his own recognizance after being encountered by border officials, and went on to apply for asylum and temporary protected status. He later applied to adjust his status and was approved for a work permit, with his residency and family petitions still pending. In August 2026 he was arrested by local police in Texas on charges of assault and unlawful restraint of a family member, but prosecutors dismissed both charges on September 2, 2026. Despite the dismissal, ICE arrested him days later under an immigration detainer and transferred him to the California City Detention Facility in California, where he has remained held. A federal judge found that redetaining him without first giving him a hearing violated his due process rights. The court ordered that he receive an individualized bond hearing within 14 days, where the government must prove by clear and convincing evidence that he is a danger or flight risk to justify continued detention.
