A man was admitted to the United States in July 2021 on a visa valid through June 10, 2022, and remained in the country after it expired. More than four years later, in August 2026, immigration authorities took him into custody without first providing notice or a hearing before a neutral decision-maker. He challenged his detention in federal court, arguing that because he had lived openly in the country for years after his visa lapsed before being detained, he had developed a protected liberty interest that required due process protections before he could be locked up. The court agreed, citing its recent rulings in similar cases, and found that the government had violated his due process rights by detaining him without a pre-deprivation bond hearing. The judge ordered his immediate release under the same conditions he had before detention, directed the government to return his identification and other documents, and ruled that if officials want to re-detain him in the future they must give seven days' notice and hold a bond hearing first.
