Ecuadorian student detained at workplace while studying, denied bail by judge

Feb 2025 · Syracuse, NY, Ecuador

Josué Alvardo, 19, a legal entrant with work authorization and a pending asylum claim, was detained by ICE in mid-February while walking into his job at a Popeyes restaurant in Onondaga County, New York. His mother filed a habeas corpus petition seeking his release, but it was denied by U.S. District Judge John Sinatra. The case highlights disparities in habeas corpus outcomes across judges in the Western District of New York, where Sinatra has approved only 1.4% of petitions compared to over 75% for other judges in the district.
