State Department proposes proof-of-status rule for children's passport applications

Sep 1, 2026

The U.S. State Department has drafted guidance requiring parents to prove their own citizenship or immigration status when applying for passports for their U.S.-born children. The policy would implement Trump's August 6 executive order targeting 'birth tourism' and narrowing birthright citizenship exceptions. Lawyers are pursuing class-action lawsuits and seeking court orders to block the directive from taking effect.
