Juan Carlos V.C.: Longtime Mexican resident detained by ICE in warrantless traffic stop

A Mexican man who has lived in the U.S. since 1999 was arrested by ICE during a traffic stop without a warrant. A federal judge found the arrest unlawful and ordered his immediate release.

Sep 25, 2026California City, CACountry of origin: Mexico

He is a native and citizen of Mexico who entered the United States in 1999 and has lived here continuously ever since. On or about September 25, 2026, ICE agents arrested him during a traffic stop. He was held at the California City Immigration Processing Center without having been arrested pursuant to a warrant, as required for his type of detention, and the government did not argue that any exception to the warrant requirement applied. He filed a petition for writ of habeas corpus challenging his detention and sought immediate release. The court found his detention unlawful because of the missing warrant and granted his habeas petition, ordering his immediate release and barring his re-detention without notice and a hearing before an immigration judge.
