Bernarlinda C.R.: 19-year-old college student redetained by ICE without notice

A 19-year-old college student with a pending asylum case and no criminal record was abruptly taken back into ICE custody after years of compliant check-ins. A judge ordered her immediate release, finding no due process was given.

A 19-year-old college student entered the United States in January 2023 and was paroled by DHS the next day after officials determined she posed no security or flight risk. She has lived freely in the U.S. for about three and a half years, enrolled at Los Angeles Trade-Technical College, and filed an affirmative asylum application with USCIS in January 2024 that was still pending. She had no criminal record and had never missed a required check-in with ICE under her parole conditions. Despite her compliance, ICE detained her again without providing written notice of any specific reason or a chance to contest it, and she was held at the Adelanto ICE Facility. A federal magistrate judge found this violated her due process rights because the government offered no evidence of any interest in detaining her, and ordered her immediate release, return of her belongings, and barred her re-detention absent strict compliance with due process.
