Pedro Luis B.M.: Man redetained by ICE without a bond hearing

A man who had been living in the U.S. on humanitarian parole was taken back into immigration custody in March 2026 without any hearing. A federal judge ordered his immediate release, finding the government violated his due process rights.

Mar 21, 2026California City, CA

A man who had been living in the United States after being released on humanitarian parole under federal immigration law was taken back into custody by immigration authorities on March 21, 2026, without any hearing before a neutral decision-maker to assess whether he should remain detained. He was held at a California detention facility while his case proceeded. His attorneys argued that re-detaining him without a pre-deprivation bond hearing violated his constitutional right to due process, pointing to a series of recent rulings from the same court finding that people released on parole have a protected liberty interest in remaining free. The government argued he was subject to mandatory detention and had no due process rights because of the 'entry fiction' doctrine, but the court rejected that argument, finding it applies only to admission decisions, not ongoing detention. The judge ordered his immediate release under the same conditions he had before his re-detention, with no additional restrictions unless determined necessary at a future hearing. The government must give him seven days' notice and a proper bond hearing before attempting to detain him again.
