Jose U.C.: Previously paroled man re-detained by ICE without bond hearing

A man previously freed on bond was re-arrested in July 2026 with no hearing and held at Golden State Annex. A judge ordered his immediate release, citing violated due process rights.

Jul 7, 2026McFarland, CA

The man had previously been released from immigration custody on bond, conditional parole, or humanitarian parole. On July 7, 2026, immigration authorities took him back into custody without first giving him a hearing before a neutral judge to determine whether he should be held. He was detained at the Golden State Annex Detention Facility while his case proceeded. A federal judge found that re-detaining someone who had already been released requires a pre-deprivation bond hearing under the Due Process Clause, and that the government failed to provide one here. The court ordered his immediate release under the same conditions he had before his July detention, directed the government to return his identification and other documents, and ruled that if officials want to detain him again they must give seven days' notice and hold a proper bond hearing first.
