Josial J.: Man re-detained by ICE with no notice or hearing
A man who had been living in the U.S. on parole since 2023 was suddenly re-detained by ICE in July 2026 with no explanation. A federal judge ordered his immediate release, finding he was never given notice or a hearing.

The man had been paroled into the United States on July 6, 2023, and was living under that parole status until he was re-detained by immigration authorities on July 15, 2026. He was given no notice explaining why he was being taken back into custody and no chance to contest the re-detention. After being detained, he asked an immigration judge for a custody hearing, but on September 17, 2026, the judge ruled that the immigration court had no jurisdiction to hear his case. He then filed a habeas corpus petition in federal court seeking his release. The federal judge found that because he had previously been released on parole, he had a liberty interest in remaining free and was entitled to notice and a hearing before being re-detained again. The court ordered his immediate release and barred immigration authorities from re-detaining him in the future without first giving him notice and a hearing where the government must prove by clear and convincing evidence that he is a danger or flight risk.
