Pedro B.U.: Man re-detained by ICE without bond hearing, held weeks

Previously released on immigration parole, he was taken back into ICE custody on August 3, 2026 without any hearing. A federal judge ruled the re-detention violated due process and ordered his immediate release.

Aug 3, 2026California City, CA

The man had previously been released into the United States on bond, conditional parole, or humanitarian parole after an earlier immigration encounter. On August 3, 2026, immigration authorities re-detained him and held him at the California City Detention Facility without giving him a new bond hearing before a neutral judge. The government argued his detention was justified because of recent law enforcement encounters, including a conviction for failing to stop for police, a conviction for driving without insurance, and a pending drug paraphernalia charge, but it did not explain why this history eliminated his right to a hearing. The federal court found that due process requires a pre-deprivation bond hearing before the government can re-detain someone who was previously released, regardless of intervening criminal charges. Because the government failed to justify skipping that hearing, the judge ordered his immediate release under the same conditions he had before his August detention, with his belongings returned and no new restrictions imposed absent a future hearing.
